Terms of Service

Welcome to Goya. These Terms of Service ("Terms") govern access to and use of the Goya website and mobile applications (iOS and Android), published by Thibault Lamour. By creating an account or using Goya, you agree to these Terms without reservation.
1. Purpose of the Service
Goya is a community platform that allows users to:
- Discover sports events organized by third parties, through location-based search
- Create a profile, add friends, and challenge each other
- For organizers, publish and manage their own events
Goya does not organize any sports event listed on the platform. Goya acts solely as a technical intermediary connecting organizers and users.
2. Eligibility and account creation
- Use of Goya is restricted to individuals at least 16 years old.
- You must provide accurate information when registering (email, name).
- You are responsible for keeping your login credentials confidential.
- Only one account per person is allowed.
- Goya reserves the right to suspend or delete any account in violation of these Terms.
3. User conduct
By using Goya, you agree to:
- Not impersonate any third party
- Not post illegal, abusive, defamatory, discriminatory content, or content infringing on others' rights
- Not harass, threaten, or intimidate other users
- Not use Goya for unauthorized commercial purposes or solicitation
- Not attempt to circumvent the platform's security measures
Any violation may result in immediate account suspension, without prejudice to potential legal action.
4. Sports events — important disclaimer
Events listed on Goya are organized by independent third parties (associations, clubs, professional or individual organizers). Goya does not organize these events and cannot be held liable for:
- their execution, cancellation, postponement, or modification
- the accuracy of information provided by the organizer (date, location, price, capacity)
- any damage, injury, or harm occurring during participation in an event
- any financial transactions between the user and the organizer, which take place outside the Goya platform
It is each user's responsibility to verify information directly with the organizer before traveling to or registering for an event, and to ensure their physical fitness to participate in the activity concerned.
5. Organizer accounts
Any user may create an organizer space to publish their own events. By creating an organizer space, you warrant that:
- The information published is accurate (dates, location, pricing, capacity)
- You hold the necessary authorizations to organize the described event
- You comply with applicable regulations for organizing sports events (insurance, administrative filings where applicable)
Goya reserves the right to disable an organizer space or remove an event that fails to meet these commitments, without notice in case of serious violation.
An organizer may also claim an existing listing (automatically created from public data) by providing proof (professional email or document). This claim is subject to manual review by Goya.
6. User-generated content
You retain ownership of content you publish on Goya (profile pictures, event descriptions). By publishing it, you grant Goya a non-exclusive, royalty-free, worldwide license to host, display, and distribute this content as part of the service's operation.
Goya reserves the right to remove any content that violates these Terms or the law, without prior notice in urgent cases.
7. Social features (friends, challenges, notifications)
Connection features (friend requests, sports challenges, visible activity) rely on information you choose to share. You can adjust your profile visibility and notification preferences at any time from your account settings.
8. Pricing and payments
Prices displayed for events are provided for informational purposes only by the organizer and may not reflect the final price. Goya does not process any payments: any financial transaction related to event registration takes place directly with the third-party organizer, outside the platform.
9. Intellectual property
The Goya brand, logo, interface, and database are protected by intellectual property law and remain the exclusive property of Thibault Lamour. Any unauthorized reproduction is prohibited.
10. Limitation of liability
To the extent permitted by applicable law, Goya shall not be liable for:
- indirect damages resulting from use or inability to use the service
- content published by organizers or other users
- temporary unavailability of the service due to maintenance or force majeure
The service is provided "as is", without warranty of error-free or uninterrupted operation.
11. Suspension and termination
You may delete your account at any time from your settings. Goya may suspend or terminate your access in case of violation of these Terms, with or without notice depending on the severity of the violation.
12. Changes to these Terms
Goya may modify these Terms at any time. Users will be notified of any substantial change. Continued use of Goya after such changes constitutes acceptance of the new Terms.
13. Governing law and jurisdiction
These Terms are governed by French law. Any dispute falls under the jurisdiction of French courts, subject to mandatory provisions applicable to consumers in their country of residence.
13 bis. Apple App Store specific terms
If you downloaded the application via Apple's App Store, the following provisions apply in addition:
- This agreement is between you and Thibault Lamour (Goya website and app) only, not Apple Inc. Apple is not responsible for the application or its content.
- The license granted to you is limited to a non-transferable license to use the application on any Apple-branded device that you own or control, as permitted by the App Store's terms of use.
- Apple has no obligation to provide any maintenance or support services for the application.
- In the event of any failure of the application to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the application; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or a third party relating to the application, including product liability claims, claims of non-conformance with legal or regulatory requirements, and consumer protection claims.
- In the event of any third-party claim that the application infringes its intellectual property rights, Thibault Lamour will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent that you are not located in a country subject to a U.S. government embargo, and are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement, and Apple has the right to enforce it against you as a third-party beneficiary.
13 ter. Google Play specific terms
You may request the deletion of your account and personal data from within the app (Profile → Account → Privacy) or, without needing to log in, via email at help@usegoya.com.
